Heeren van Kapelle's estates are ranked as estates under the 1928 Natural Attractions Act. This ranking gives a number of attractive tax advantages (indicative information, always consult your own tax specialist):
• On purchase, you pay no transfer tax
• A lower WOZ value applies to the house (and garage), namely the zoning value instead of the usual economic value. This lowers the owner-occupied house lump sum for income tax, as well as the annual property tax assessments and water board charges.
• The associated land is exempt for box 3 of income tax (capital gains tax).
• You can gift the estate – if it is open-ended – tax-free. If an estate is not open-ended, only half of the earmarked value is subject to gift tax.
•Upon death, – if the estate is open – no inheritance tax needs to be paid on the inheritance of an estate. If the estate is not open, only half of the earmarked value is subject to inheritance tax.
